Article R6153-46 of the French Public Health Code

From the first year of the second cycle of medical studies until their appointment as an intern, hospital medical students, whether they are medical students in advanced training or auditors in application of 2° of article R. 632-10 of the Education Code, participate, under the conditions defined by the present section, in hospital and outpatient activities and receive, under the conditions provided for in article R. 6153-58, remuneration paid by the university hospital centre to which they are attached and which is linked by agreement to the medical training and research unit in which they are registered.

In this capacity, they have the status of public servants and are, in particular, subject to professional secrecy and the obligation of professional discretion with regard to all facts, information or documents of which they become aware in the course of their hospital activities.

The provisions of this section apply to the auditors mentioned in 2° of article R. 632-10 of the Education Code, with the exception of the last paragraph of article R. 6153-58.

A partir de la première année du deuxième cycle des études médicales et jusqu’à leur nomination en qualité d’interne, les étudiants hospitaliers en médecine, qu’ils soient étudiants en médecine en formation approfondie ou auditeurs en application du 2° de l’article R. 632-10 du code de l’éducation, participent, dans les conditions définies par la présente section, à l’activité hospitalière et ambulatoire et perçoivent, dans les conditions prévues à l’article R. 6153-58, une rémunération versée par le centre hospitalier universitaire de rattachement lié par convention à l’unité de formation et de recherche médicale dans laquelle ils sont inscrits.

A ce titre, ils ont la qualité d’agent public et sont notamment soumis au secret professionnel et à l’obligation de discrétion professionnelle pour tous les faits, informations ou documents dont ils ont connaissance à l’occasion de l’exercice de leur activité hospitalière.

Les dispositions de la présente section sont applicables aux auditeurs mentionnés au 2° de l’article R. 632-10 du code de l’éducation, à l’exception du dernier alinéa de l’article R. 6153-58.
