Article R618-1 of the French Intellectual Property Code

Any notification shall be deemed to be in order if it is made:

– either to the last owner of the patent application declared to the National Institute of Industrial Property or, after the publication provided for in Article R. 612-39, to the last owner of the patent application or of the patent entered in the National Patent Register;

– or to the agent.

If the proprietor is not domiciled in a Member State of the European Community or in a State party to the Agreement on the European Economic Area, the notification shall be deemed to be in order if it is made to the last agent that he has appointed with the Institute.

Toute notification est réputée régulière si elle est faite :

– soit au dernier propriétaire de la demande de brevet déclaré à l’Institut national de la propriété industrielle ou, après la publication prévue à l’article R. 612-39, au dernier propriétaire de la demande de brevet ou du brevet inscrit au Registre national des brevets ;

– soit au mandataire.

Si le titulaire n’est pas domicilié dans un Etat membre de la Communauté européenne ou dans un Etat partie à l’accord sur l’Espace économique européen, la notification est réputée régulière si elle est faite au dernier mandataire qu’il a constitué auprès de l’institut.
