In addition to the powers conferred on him by the application of the first paragraphs of Articles 16 and 18 of the above-mentioned Act of 20 January 2017 , the Chairman shall exercise the powers of the head of the company for the application of the Labour Code. The Chairman represents the AMF in all civil and legal matters.
Within the framework of the general rules laid down by the Board, the Chairman is empowered to:
1° Settle and authorise income and expenditure;
2° Keep accounts of expenditure commitments, under the conditions defined by the accounting and financial regulations;
3° Manage cash balances and decide on investments;
4° To enter into all contracts, agreements and procurement contracts on behalf of the Autorité des marchés financiers, and to decide on the purchase or sale of property leases;
5° Hiring, managing and dismissing staff and setting remuneration and allowances;
6° Proposing to the Board the internal regulations and rules of professional conduct applicable to the staff of the departments;
7° Set the system of mission and travel allowances for AMF staff.
In matters falling within his remit, the Secretary General is authorised to enter into settlements on behalf of the Autorité des marchés financiers under the conditions laid down in Articles 2044 to 2052 of the Civil Code.
In matters falling within his remit, the Secretary General may delegate his signature within the limits that he shall determine and designate the persons authorised to represent him.
The General Secretary’s remuneration is set by the Chairman after consultation with the Board.
