Article R621-37-5 of the French Monetary and Financial Code

The administrative composition procedure is definitively interrupted :

1° If the person to whom it has been proposed refuses or fails to make a decision within the time limit set in article R. 621-37-2;

2° If no agreement is reached within the time limits set out in article R. 621-37-3 and the second paragraph of article R. 621-37-4;

3° If the agreement is not validated by the college and the procedure referred to in the second paragraph of Article R. 621-37-4 is not applied;

4° If the Enforcement Committee refuses to approve the agreement validated by the college;

5° If the signatory fails to comply with the agreement.

Articles R. 621-38 to R. 621-42 are then applied.

Article R621-37-5

La procédure de composition administrative est définitivement interrompue :

1° Lorsque la personne à laquelle elle a été proposée exprime un refus ou omet de se prononcer dans le délai fixé à l’article R. 621-37-2 ;

2° A défaut d’accord conclu dans les délais mentionnés à l’article R. 621-37-3 et au deuxième alinéa de l’article R. 621-37-4 ;

3° Lorsque l’accord n’est pas validé par le collège et qu’il n’est pas fait application de la procédure mentionnée au deuxième alinéa de l’article R. 621-37-4 ;

4° Lorsque la commission des sanctions refuse d’homologuer l’accord validé par le collège ;

5° En cas de non-respect de l’accord par la personne signataire.

Il est alors fait application des articles R. 621-38 à R. 621-42.
