Article R621-39-8 of the French Monetary and Financial Code

If the challenged member agrees to the challenge, he/she is replaced as described in article R. 621-39-1.

The person making the request is notified by any means of the date on which it will be examined and of the opportunity he or she will have to make oral observations.

The Committee shall take its decision without the participation of the member whose challenge is requested; if he is not the challenged member, the rapporteur shall take part in the deliberations.

The committee’s decision is notified to the person who submitted the request and to the member concerned.

If the challenge is accepted, the challenged member is replaced as described in Article R. 621-39-1.

Si le membre récusé acquiesce à la demande de récusation, il est procédé pour son remplacement comme il est dit à l’article R. 621-39-1.

Dans le cas contraire, la commission se prononce sur la demande.L’auteur de celle-ci est averti par tous moyens de la date à laquelle elle sera examinée ainsi que de la possibilité qu’il aura de présenter des observations orales.

La commission statue sans la participation de celui de ses membres dont la récusation est demandée.S’il n’est pas le membre récusé, le rapporteur participe à la délibération.

La décision de la commission est notifiée à l’auteur de la demande et au membre intéressé.

Si la récusation est admise, il est procédé pour le remplacement du membre récusé comme il est dit à l’article R. 621-39-1.
