Natural or legal persons meeting the following conditions may apply for an increase in penalties under VI of Article L. 621-15 of the Monetary and Financial Code :
1° No further appeal may be lodged against the decision imposing the permanent disqualification or permanent withdrawal of the professional licence;
2° The sanctions of permanent disqualification or withdrawal of the professional licence have already been enforced for at least ten years;
3° Any fine imposed in addition to the prohibition from practising or the withdrawal of the professional licence has been paid in full;
4° No conviction has been entered in bulletin no. 3 of the criminal record subsequent to the sanction, nor has any new sanction that has become final been imposed on the applicant on the basis of this Code, its implementing texts or European regulations with a similar scope of application, for acts other than those that gave rise to the decision to prohibit the applicant from practising or to withdraw the professional licence.
