Article R621-41-1 of the French Monetary and Financial Code

Natural or legal persons meeting the following conditions may apply for an increase in penalties under VI of Article L. 621-15 of the Monetary and Financial Code :

1° No further appeal may be lodged against the decision imposing the permanent disqualification or permanent withdrawal of the professional licence;

2° The sanctions of permanent disqualification or withdrawal of the professional licence have already been enforced for at least ten years;

3° Any fine imposed in addition to the prohibition from practising or the withdrawal of the professional licence has been paid in full;

4° No conviction has been entered in bulletin no. 3 of the criminal record subsequent to the sanction, nor has any new sanction that has become final been imposed on the applicant on the basis of this Code, its implementing texts or European regulations with a similar scope of application, for acts other than those that gave rise to the decision to prohibit the applicant from practising or to withdraw the professional licence.

Article R621-41-1

Peuvent présenter une demande de relèvement des sanctions au titre du VI de l’article L. 621-15 du code monétaire et financier les personnes physiques ou morales qui satisfont aux conditions suivantes :

1° La décision ayant prononcé la sanction d’interdiction d’exercice à titre définitif ou de retrait définitif de la carte professionnelle n’est plus susceptible de recours ;

2° Les sanctions d’interdiction d’exercice ou de retrait de la carte professionnelle ont déjà été exécutées pendant au moins dix ans ;

3° La sanction pécuniaire, éventuellement prononcée en sus de l’interdiction d’exercice ou du retrait de la carte professionnelle, a été intégralement acquittée ;

4° Aucune condamnation, n’a été inscrite sur le bulletin n° 3 du casier judiciaire postérieurement à la sanction, ni aucune nouvelle sanction ayant acquis un caractère définitif n’a été prononcée à l’encontre du demandeur sur le fondement du présent code, de ses textes d’application ou de règlements européens ayant un champ d’application similaire, pour des faits distincts de ceux ayant donné lieu à la décision d’interdiction d’exercice ou de retrait de la carte professionnelle.
