Article R621-41-2 of the French Monetary and Financial Code

The request for an increase must be made in the following form and under the following conditions:

1° The request is sent by registered letter with acknowledgement of receipt to the chairman of the Enforcement Committee;

2° In the case of natural persons, the application shall state the surname, first name, profession and domicile of the applicant; in the case of legal entities, the application shall state their name, legal form and registered office as well as the body that legally represents them;

3° The following are attached

a) A copy of the decision imposing the permanent ban on practising or the permanent withdrawal of the professional card whose lifting is requested and, where applicable, a copy of the decisions of the appeal courts;

b) A detailed statement of the reasons justifying the request for removal;

c) Where necessary, the documents that the applicant wishes to invoke in support of his application.

La demande de relèvement est présentée dans les formes et conditions suivantes :

1° La demande est adressée, par lettre recommandée avec demande d’avis de réception, au président de la commission des sanctions ;

2° La demande mentionne, pour les personnes physiques, l’indication des nom, prénom, profession et domicile du requérant ; elle mentionne, pour les personnes morales, l’indication de leur dénomination, forme et siège social ainsi que de l’organe qui les représente légalement ;

3° Sont joints :

a) Une copie de la décision ayant prononcé la sanction d’interdiction d’exercice à titre définitif ou de retrait définitif de la carte professionnelle dont il est demandé le relèvement ainsi que, le cas échéant, copie des décisions des juridictions de recours ;

b) Un exposé détaillé des raisons justifiant la demande de relèvement ;

c) En tant que de besoin, les pièces que le demandeur souhaite invoquer à l’appui de sa demande.
