Article R621-41-4 of the French Monetary and Financial Code

The applicant is summoned by registered letter with acknowledgement of receipt to be heard by the Enforcement Committee.

They may be assisted or represented by a person of their choice.

If the applicant or the person representing him fails to attend the meeting without a legitimate reason, he is deemed to have withdrawn. The claimant will be informed accordingly.

The Committee shall reach its decision after hearing the observations of the representative of the College and of the applicant.

The meeting is not open to the public, unless the person concerned requests otherwise and the Chairman of the Committee agrees.

Le demandeur est convoqué par lettre recommandée avec demande d’avis de réception pour être entendu par la commission des sanctions.

Il peut être assisté ou représenté par la personne de son choix.

Si le demandeur ou la personne qui le représente ne se présente pas à la séance sans motif légitime, il est réputé s’être désisté. Il lui en est donné acte.

La commission statue après avoir recueilli les observations du représentant du collège ainsi que du demandeur.

La séance n’est pas publique, sauf demande de l’intéressé acceptée par le président de la commission.
