Article R621-41-5 of the French Monetary and Financial Code

In assessing the merits of the request for an increase in the penalty, the Commission will take into account any new factors likely to justify an increase in the penalty, such as a finding by the European Court of Human Rights that there has been a breach of the rights guaranteed by the European Convention for the Protection of Human Rights and Fundamental Freedoms, a final acquittal decision by the criminal court, or the measures taken by the applicant to put an end to the situation that gave rise to the sanctioned breach and to remedy the prejudicial consequences of this breach for third parties.

Pour apprécier le bien-fondé de la demande de relèvement, la commission tient compte, le cas échéant, des éléments nouveaux susceptibles de justifier le relèvement de la sanction, tels que la constatation par la Cour européenne des droits de l’Homme d’une méconnaissance des droits garantis par la convention européenne de sauvegarde des droits de l’homme et des libertés fondamentales, une décision de relaxe définitive prise par le juge pénal, ou les dispositions prises par le demandeur pour mettre fin à la situation à l’origine du manquement sanctionné et pour remédier aux conséquences préjudiciables pour les tiers de ce manquement.
