Article R621-48 of the French Monetary and Financial Code

Each employment contract concluded between the AMF and one of its agents or employees specifies whether the contract is governed by public law or by the Labour Code. The contracts of contractual agents governed by public law are subject to the provisions of Decree no. 86-83 of 17 January 1986 relating to the general provisions applicable to contractual agents of the State, with the exception of the provisions of articles 43 and 44 of this decree relating to discipline.

Chaque contrat de travail conclu entre l’Autorité des marchés financiers et l’un de ses agents ou salariés précise s’il relève du droit public ou du code du travail. Les contrats des agents contractuels de droit public sont soumis aux dispositions du décret n° 86-83 du 17 janvier 1986 relatif aux dispositions générales applicables aux agents contractuels de l’Etat, à l’exception des dispositions des articles 43 et 44 de ce décret relatives à la discipline.
