I. – The Enforcement Committee shall be convened by its Chairman when it is acting in plenary session, and by the Chairman of the relevant Section in other cases. It may only deliberate in the presence of at least seven members when deciding in plenary session and at least three members when deciding in section. When, pursuant to Article 12 of the aforementioned Act of 20 January 2017, a member does not take part in the deliberations of a section, he shall be replaced under the conditions provided for in the last paragraph of this I.
In the event of absence, the Chairman of the Commission shall entrust one of the other members falling under 1° or 2° of IV of Article L. 621-2 with the task of chairing the plenary session.
In the event of absence, the chairman of one section may be replaced by the chairman of the other section or, failing this, by another member falling under 1° or 2° of IV of Article L. 621-2, whom he entrusts with chairing the meeting.
If a member from one of the categories of persons mentioned in 3° or 4° of IV of Article L. 621-2 is absent, the Division Chairman may ask a member from the other Division, chosen from the same category of persons, to deputise. If another member is absent, the Chairman of the Division may ask another member of the other Division, chosen from one of the categories of persons mentioned in 1° or 2° of IV of Article L. 621-2, to deputise.
II. – Any member of the Enforcement Committee who fails to attend three consecutive meetings, except in cases of force majeure as determined by the Chairman, shall be deemed to have resigned. The chairman of the Enforcement Committee informs the Minister for the Economy.
