Article R621-8-2 of the French Commercial code

For the application of the fourth paragraph of Article L. 621-2, the judge shall determine the amount of the sums for which the protective measure is ordered in the light of the liabilities declared in the collective proceedings opened or, if the time limit mentioned in the first paragraph of Article R. 622-24 has not expired, in the light of the statements mentioned in Article R. 625-1.

Pour l’application du quatrième alinéa de l’article L. 621-2, le juge détermine le montant des sommes pour la garantie desquelles la mesure conservatoire est ordonnée au vu du passif déclaré dans la procédure collective ouverte ou, si le délai mentionné au premier alinéa de l’article R. 622-24 n’est pas expiré, au vu des relevés mentionnés à l’article R. 625-1.
