Article R6211-5 of the French Labour Code

The region may allocate a fraction of the resources allocated to it in application of I of article R. 6211-4 to the capital expenditure mentioned in 2° of I of article L. 6211-3 when, over the same period, it notes:

1° An amount of committed or forecast operating expenditure that is less than the amount of resources allocated for this purpose;

2° An amount of committed or forecast capital expenditure that is greater than the amount of resources allocated for this purpose.

The fraction of resources referred to in the first paragraph may not exceed a ceiling set by order of the Minister responsible for vocational training within the limit of 82% of the annual amount of resources allocated for the operating expenses referred to in 1° of I of article L. 6211-3.

The fraction of resources reallocated in application of the first paragraph, as well as the amount of the sum corresponding to the application of this fraction, are communicated for information to the State representative in the region and to France Compétences.

Article R6211-5

La région peut affecter une fraction des ressources qui lui sont allouées en application du I de l’article R. 6211-4 aux dépenses d’investissement mentionnées au 2° du I de l’article L. 6211-3 lorsqu’elle constate sur une même période :

1° Un montant de dépenses de fonctionnement engagées ou prévisionnelles inférieur au montant des ressources allouées à ce titre ;

2° Un montant de dépenses d’investissement engagées ou prévisionnelles supérieur au montant des ressources allouées à ce titre.

La fraction des ressources mentionnée au premier alinéa ne peut être supérieure à un plafond fixé par arrêté du ministre chargé de la formation professionnelle dans la limite de 82 % du montant annuel des ressources allouées pour les dépenses de fonctionnement mentionnées au 1° du I de l’article L. 6211-3.

La fraction des ressources faisant l’objet d’une réaffectation en application du premier alinéa, ainsi que le montant de la somme correspondant à l’application de cette fraction, sont communiqués pour information au représentant de l’Etat dans la région et à France compétences.
