A member who has been struck off the Register or who has been subject to the criminal sanctions referred to in articles L. 6242-1 and L. 6242-2 has six months, from the date on which the decision to strike him off the Register or the court decision became final, to sell his shares under the conditions set out in articles R. 6223-26 to R. 6223-28.
In the case of a partner registered on the roll of a professional association, this period begins, in the case of a definitive prohibition by disciplinary measure, on the date on which the decision becomes definitive, and in the case of an application for withdrawal from the roll made by the interested party, on the date of notification to the association; in the case of a partner authorised to practise pursuant to article L. 6221-2, it begins on the date of notification of withdrawal of authorisation.
If, on expiry of this period, no transfer has been made, the company will proceed with the transfer or buy-back under the conditions set out in the second paragraph of Article R. 6223-29.
