Article R6223-5 of the French Public Health Code

On pain of being unenforceable against third parties, the legal representative of the company must notify the president of each council of the order to which it belongs, by any means that provides proof of its date of receipt and within one month of the date on which it occurs, of any change in the situation declared in application of article R. 6223-3, attaching supporting documents.

Under the same conditions, when a private practice company of medical biologists participates in the capital of another private practice company, an information note designating the latter and specifying the distribution of capital resulting from this participation is sent by its legal representative to the president of each council of the order to which it belongs.

A peine d’inopposabilité aux tiers, le représentant légal de la société communique au président de chaque conseil de l’ordre dont elle relève, par tout moyen permettant de rapporter la preuve de sa date de réception et dans le mois suivant la date à laquelle il se produit, tout changement dans la situation déclarée en application de l’article R. 6223-3, en joignant les pièces justificatives.

Dans les mêmes conditions, lorsqu’une société d’exercice libéral de biologistes médicaux participe au capital d’une autre société d’exercice libéral, une note d’information désignant cette dernière et précisant la répartition du capital issue de cette participation est communiquée par son représentant légal au président de chaque conseil de l’ordre dont elle relève.
