Article R6223-55 of the French Public Health Code

If the liquidator has not been appointed or has refused to accept his duties, the President of the Commercial Court of the place of the registered office, acting in summary proceedings at the request of the public prosecutor or any other interested person, appoints the liquidator.

The same procedure is used to replace the liquidator in the event of his death or resignation or for serious reasons.

Le liquidateur n’a pas été désigné ou a refusé d’accepter ses fonctions, le président du tribunal judiciaire du lieu du siège social, statuant en référé à la requête du procureur de la République ou de toute autre personne intéressée, nomme le liquidateur.

Il est procédé de la même manière pour pourvoir au remplacement du liquidateur en cas de décès ou de démission de celui-ci ou pour motif grave.
