Article R6223-83 of the French Public Health Code

Registration of the company in the Trade and Companies Register is governed by articles R. 123-31 et seq. of the Commercial Code, subject to the provisions of this article.

The joint representative referred to in article R. 6223-81 sends a copy of the application for registration with the professional body referred to in article R. 6223-81 and, where applicable, the decision of the competent professional body referred to in article R. 6223-82 to the registry of the court where the application for registration was filed.

On receipt of this document, the Registrar registers the company and informs the President of the Council of the Association or Associations with which the company is registered and the Director General of the Regional Health Agency.

The company is exempt from the publication formalities provided for in articles R. 210-16 et seq. of the French Commercial Code.

L’immatriculation de la société au registre du commerce et des sociétés est régie par les articles R. 123-31 et suivants du code de commerce, sous réserve des dispositions du présent article.

Le mandataire commun mentionné à l’article R. 6223-81 adresse au greffe du tribunal où a été déposée la demande d’immatriculation une copie de la demande d’inscription à l’ordre prévue à l’article R. 6223-81 et, le cas échéant, la décision du conseil de l’ordre compétent prévue à l’article R. 6223-82.

A la réception de ce document, le greffier procède à l’immatriculation et en informe le président du conseil de l’ordre ou des ordres auprès duquel ou desquels la société est inscrite ainsi que le directeur général de l’agence régionale de santé.

La société est dispensée de procéder aux formalités de publicité prévues aux articles R. 210-16 et suivants du code de commerce.
