Article R623-12 of the French Intellectual Property Code

As an exception to the provisions of Article R. 623-4, a provisional reference may be given instead of a denomination to designate the variety which is the subject of the application at the time of filing. In this case, the denomination must be proposed, failing which the application will be inadmissible, within two months of the notification sent to the holder of the application by the person in charge of the tasks falling within the remit of the national plant variety authority.

Par dérogation aux dispositions de l’article R. 623-4, une référence provisoire peut être donnée à la place d’une dénomination pour désigner la variété qui fait l’objet de la demande au moment du dépôt de celle-ci. Dans ce cas, la dénomination doit être proposée sous peine d’irrecevabilité de la demande dans les deux mois de la notification qui est adressée au titulaire de la demande par le responsable des missions relevant de l’instance nationale des obtentions végétales.
