Article R623-21 of the French Intellectual Property Code

The person in charge of the tasks falling within the remit of the national plant variety authority, duly referred to under the conditions provided for above, proceeds with the examination of the application for a plant variety certificate and, where appropriate, with the examination of the observations relating thereto.

It determines the terms and conditions of the examination.

By application of the provisions of Article L. 623-12, it may decide not to carry out a prior examination if it is clear from the French or foreign documents in its possession that such an examination has already been carried out and that the information they contain appears sufficient to enable it to reach a decision.

In the event that the person in charge of the tasks falling within the remit of the national plant variety authority decides to have an examination of the variety carried out, he/she shall determine the duration and terms of such examination. This examination relates to distinctness, uniformity and stability, excluding any assessment of cultivation value; it is carried out only on proof of payment of the fee due.

Le responsable des missions relevant de l’instance nationale des obtentions végétales régulièrement saisi dans les conditions prévues ci-dessus procède à l’instruction de la demande de certificat d’obtention végétale et, le cas échéant, à l’examen des observations qui s’y rapportent.

Il arrête les modalités de l’instruction.

Par application des dispositions de l’article L. 623-12, il peut décider de ne pas procéder à un examen préalable s’il résulte des documents français ou étrangers en sa possession qu’un tel examen a déjà été effectué et que les renseignements qu’ils contiennent lui apparaissent suffisants pour lui permettre de prendre une décision.

Dans le cas où le responsable des missions relevant de l’instance nationale des obtentions végétales décide de faire procéder à un examen de la variété, il en fixe la durée et les modalités. Cet examen porte sur la distinction, l’homogénéité et la stabilité, à l’exclusion de toute appréciation sur la valeur culturale ; il n’est effectué que sur justification du paiement de la redevance exigible.
