Article R623-3 of the French Intellectual Property Code

Natural or legal persons who do not have their domicile, registered office or place of business in a Member State of the European Union and who, pursuant to Article L. 623-6, apply for plant variety certificates, must, within two months of receipt of the notification sent to them to this effect, appoint a representative whose domicile, registered office or establishment is in a Member State of the European Union.

Unless otherwise stipulated, the power of attorney of the agent appointed under the conditions provided for in Article R. 623-2 and the preceding paragraph shall extend to all acts and the receipt of all notifications provided for in this section, with the exception of the withdrawal of the application or the surrender of the certificate.

The power of attorney is exempt from legalisation.

Article R623-3

Les personnes physiques ou morales n’ayant pas leur domicile, siège ou établissement dans un Etat membre de l’Union européenne et qui, en application de l’article L. 623-6, demandent des certificats d’obtention végétale, doivent, dans un délai de deux mois à compter de la réception de la notification qui leur est adressée à cet effet, constituer un mandataire ayant son domicile, siège ou établissement dans un Etat membre de l’Union européenne.

Sauf stipulation contraire, le pouvoir du mandataire désigné dans les conditions prévues à l’article R. 623-2 ainsi qu’à l’alinéa précédent s’étend à tous les actes et à la réception de toutes les notifications prévus à la présente section, à l’exception du retrait de la demande ou de la renonciation au certificat.

Le pouvoir est dispensé de légalisation.
