Article R623-35 of the French Intellectual Property Code

If the owner of the plant variety certificate has lodged an appeal with the Paris Court of Appeal against the decision of the person in charge of the tasks falling within the remit of the national plant variety authority taken pursuant to Article L. 623-23, mention of the lodging of the appeal is automatically entered in the National Register of Plant Variety Certificates and the effects of the lapse are suspended until the court’s ruling has become final.

The decision of the Paris Court of Appeal is entered in the National Register of Plant Variety Certificates. It is accompanied, where appropriate, by a note that the owner of the plant variety certificate has appealed to the Court of Cassation. In the event of an appeal, the judgment of the Court of Cassation is entered in the Register under the same conditions.

Si le propriétaire du certificat d’obtention végétale a formé devant la cour d’appel de Paris un recours contre la décision du responsable des missions relevant de l’instance nationale des obtentions végétales prise en application de l’article L. 623-23, mention de l’introduction du recours est portée d’office au Registre national des certificats d’obtention végétale et les effets de la déchéance sont suspendus jusqu’à ce que l’arrêt de la cour soit devenu définitif.

La décision de la cour d’appel de Paris est inscrite au Registre national des certificats d’obtention végétale. Elle est accompagnée, le cas échéant, de la mention que le propriétaire du certificat d’obtention végétale s’est pourvu en cassation. En cas de pourvoi, l’arrêt de la Cour de cassation est inscrit au registre dans les mêmes conditions.
