Article R623-39 of the French Intellectual Property Code

Applications for plant variety certificates are entered in the register of applications in chronological order, immediately after the application is filed.

For each application, the entry includes in particular:

the provisional registration number;

the filing date;

an indication of the genus or species to which the variety belongs;

the name and address of the breeder and, where applicable, of his agent or successor in title where the breeder is not the applicant;

the proposed denomination or, failing that, the breeder’s reference and, where applicable, the denomination under which the variety has been designated by the other members of the International Union for the Protection of New Varieties of Plants;

the priority claim where one has been made;

the mention of the observations referred to in the articles R. 623-17 to R. 623-26 ;

-the date of issue of the plant variety certificate with its registration number in the National Register of Plant Variety Certificates or the mention of the definitive rejection.

The applicant’s description of the variety and that of the breeding process are appended to the register, subject to the provisions of Article R. 623-44.

Article R623-39

Au registre des demandes sont inscrites dans l’ordre chronologique les demandes de certificat d’obtention végétale, aussitôt après le dépôt de la demande.

Pour chaque demande, l’inscription comporte notamment :

-le numéro provisoire d’enregistrement ;

-la date de dépôt ;

-l’indication du genre ou espèce auquel appartient la variété ;

-les nom et adresse de l’obtenteur et, s’il y a lieu, de son mandataire ou ayant cause lorsque l’obtenteur n’est pas le déposant ;

-la dénomination proposée ou, à défaut, la référence d’obtenteur ainsi que, le cas échéant, la dénomination sous laquelle la variété a été désignée par les autres membres de l’Union internationale pour la protection des obtentions végétales ;

-la revendication de priorité dans le cas où il en a été formulé ;

-la mention des observations visées aux articles R. 623-17 à R. 623-26 ;

-la date de délivrance du certificat d’obtention végétale avec son numéro d’inscription au Registre national des certificats d’obtention végétale ou la mention du rejet définitif.

La description de la variété faite par le demandeur et celle du procédé d’obtention sont portées en annexe au registre, sous réserve des dispositions de l’article R. 623-44.
