Article R623-44 of the French Intellectual Property Code

With regard to applications for plant variety certificates for varieties belonging to species included in the list established by order made pursuant to article L. 623-9, the procedures provided for by articles R. 623-16 to R. 623-30 may not be initiated during the period of the prohibitions prescribed by the said article, unless the special authorisation provided for by article L. 623-9 is obtained. Nor may they be initiated during the term of the prohibitions extended pursuant to Article L. 623-10.

For the duration of the prohibitions, the appending to the Register of applications for plant variety certificates, as provided for by article R. 623-39, of the variety description made by the applicant and its breeding process is also suspended.

En ce qui concerne les demandes de certificat d’obtention végétale de variétés appartenant aux espèces comprises dans la liste fixée par arrêté pris en application de l’article L. 623-9, les procédures prévues par les articles R. 623-16 à R. 623-30 ne peuvent, sauf intervention de l’autorisation spéciale prévue par l’article L. 623-9, être engagées pendant la durée des interdictions prescrites par ledit article. Elles ne peuvent l’être non plus pendant la durée des interdictions prorogées en application de l’article L. 623-10.

Pendant la durée des interdictions, il est en outre sursis à la mise en annexe au Registre des demandes de certificats d’obtention végétale, telle que prévue par l’article R. 623-39, de la description de variété faite par le demandeur et de son procédé d’obtention.
