Article R623-49 of the French Intellectual Property Code

Any notification shall be deemed to be in order if it is made to the last owner of the application for a plant variety certificate, or of the plant variety certificate as it appears in the Register of Applications for Plant Variety Certificates or in the National Register of Plant Variety Certificates.

If the owner is domiciled abroad, notification shall be made to the last agent and to the last elected domicile that he has designated to the person in charge of missions relating to the national plant variety authority.

Toute notification est réputée régulière si elle est faite au dernier propriétaire de la demande de certificat d’obtention végétale, ou du certificat d’obtention végétale tel qu’il figure au Registre des demandes de certificats d’obtention végétale ou au Registre national des certificats d’obtention végétale.

Si le propriétaire est domicilié à l’étranger, la notification est faite au dernier mandataire et au dernier domicile élu qu’il a désigné au responsable des missions relevant de l’instance nationale des obtentions végétales.
