Article R623-9 of the French Intellectual Property Code

The benefit of the right of priority may only be granted if:

1. Within a period of three months from the filing date of the application, the applicant submits to the person in charge of the missions under the national plant variety authority a copy of the documents constituting the previous filing with any other member of the International Union for the Protection of New Varieties of Plants, certified as true by the administration which will have received it accompanied by a translation;

2. Within two years of the expiry of the priority period, he shall provide the additional documents and, where applicable, the propagating or vegetative propagating material required for the preliminary examination.

Le bénéfice du droit de priorité ne peut être accordé que si :

1. Dans un délai de trois mois à dater du dépôt de la demande, le déposant remet au responsable des missions relevant de l’instance nationale des obtentions végétales une copie des documents constituant le dépôt antérieur auprès de tout autre membre de l’Union internationale pour la protection des obtentions végétales, certifiée conforme par l’administration qui l’aura reçue accompagnée d’une traduction ;

2. Dans un délai de deux ans après l’expiration du délai de priorité, il fournit les documents complémentaires ainsi que, s’il y a lieu, le matériel de multiplication ou de reproduction végétative nécessaire à l’examen préalable.
