The verification of claims is carried out by the mandataire judiciaire, the debtor and, where applicable, the designated auditors, present or duly summoned.
If a claim other than that mentioned in article L. 625-1 is discussed, the mandataire judiciaire shall notify the creditor or its agent by registered letter with acknowledgement of receipt. The thirty-day period provided for in article L. 622-27 short from receipt of the letter. This letter specifies the subject of the discussion, indicates the amount of the claim for which registration is proposed and recalls the provisions of article L. 622-27.
The period provided for in the second paragraph of Article L. 624-1 is thirty days. It runs from the date on which the debtor has been given the opportunity by the mandataire judiciaire to make his observations. Where the debtor does not take part in the verification of the claims, the period runs from receipt of the registered letter with acknowledgement of receipt sent to him by the mandataire judiciaire. This letter includes the proposals for admission, rejection or dismissal mentioned in the first paragraph of Article L. 624-1.
It is up to the judicial representative to provide proof of the date on which he/she requested the debtor’s observations.
