Article R624-6 of the French Commercial code

At the request of the Public Treasury, the official receiver, after obtaining the opinion of the judicial representative, shall pronounce the definitive admission of claims provisionally admitted pursuant to the fourth paragraph of Article L. 622-24 and which have been the subject of a writ of execution or are no longer contested. When the official receiver is no longer in office, the president of the court, at the request of the representative of the Public Treasury, pronounces the final admission. The decisions are entered on the statement of claims.

Decisions rendered in disregard of the provisions of the fourth paragraph of Article L. 622-24 are subject to appeal.

Article R624-6

A la requête du Trésor public, le juge-commissaire, après avoir recueilli l’avis du mandataire judiciaire, prononce l’admission définitive des créances admises à titre provisionnel en application du quatrième alinéa de l’article L. 622-24 et qui ont fait l’objet d’un titre exécutoire ou ne sont plus contestées. Lorsque le juge-commissaire n’est plus en fonctions, le président du tribunal, saisi par requête du représentant du Trésor public, prononce l’admission définitive. Les décisions sont portées sur l’état des créances.

Les décisions rendues en méconnaissance des dispositions du quatrième alinéa de l’article L. 622-24 sont susceptibles d’appel.
