Article R628-8 of the French Commercial code

Within ten days of the opening judgment, the debtor shall file two copies of the list of claims provided for by Article L. 628-7 at the court registry. The court clerk shall give one copy to the judicial representative.

The list shall include the items mentioned in the first two paragraphs of article L. 622-25 and in the first sentence of article R. 622-5 as well as in 2° of article R. 622-23. Where the holders of capital are affected by the draft plan, the list is supplemented by information relating to the terms of participation in the debtor’s capital, the articles of association and the rights of the holders of capital. This information shall be accompanied by any useful document or supporting evidence.

If the information on this list and that on the list provided for in article L. 622-6 differ, only the former shall be taken into consideration.

Article R628-8

Dans les dix jours du jugement d’ouverture, le débiteur dépose au greffe deux exemplaires de la liste des créances prévue par l’article L. 628-7. Le greffier en remet un exemplaire au mandataire judiciaire.

La liste comporte les éléments mentionnés aux deux premiers alinéas de l’article L. 622-25 et à la première phrase de l’article R. 622-5 ainsi qu’au 2° de l’article R. 622-23. Lorsque les détenteurs de capital sont affectés par le projet de plan, la liste est complétée par des informations relatives aux modalités de participation au capital du débiteur, aux statuts et aux droits des détenteurs de capital. Ces informations sont accompagnées de tout document ou pièce justificative utiles.

Si les informations portées sur cette liste et celles portées sur la liste prévue à l’article L. 622-6 diffèrent, seules les premières sont prises en considération.
