Article R631-35 of the French Commercial code

The articles R. 626-17 to R. 626-51, excluding article R. 626-18, the second and third paragraphs of article R. 626-20, and of article R. 626-22, are applicable to the receivership proceedings.

The court clerk shall proceed with the summonses and notices mentioned in article R. 626-17 as soon as the draft plan has been filed at the court clerk’s office by the administrator.

For the application of Article R. 626-48, when the court decides to resolve the plan pursuant to the third paragraph of I of article L. 626-27, it opens the judicial liquidation of the debtor in the same judgment.

Le greffier procède aux convocations et avis mentionnés à l’article R. 626-17 dès le dépôt au greffe du projet de plan par l’administrateur.

Pour l’application de l’article R. 626-48, lorsque le tribunal décide la résolution du plan en application du troisième alinéa du I de l’article L. 626-27, il ouvre, dans le même jugement, la liquidation judiciaire du débiteur.
