I.-The General Director of the Regional Health Agency will transfer the authorisation at the request of and in favour of the holder in the event of the replacement of:
-a category A vehicle by a category A or C vehicle;
-a category C vehicle by a category A or C vehicle;
-a category D vehicle by a category D vehicle.
II.-1The transfer of the initial authorisation to put a healthcare vehicle into service is subject to the prior agreement of the Director General of the Regional Health Agency in the event of:
-a change in the category of the vehicle;
-a change in the location of the vehicle;
-a transfer of the vehicle or of the right to use this vehicle, to the transferee and at the request of the transferee in respect of the same category and the same department.
If there is no response within two months of receipt of the application, this will be deemed to be tacit approval.
2° The transfer may only be refused for one of the following reasons, assessed on the date of the decision:
-the need to meet the local health needs of the population in the department;
-the local competitive situation;
-compliance with the theoretical number of vehicles allocated to health transport referred to in article R. 6312-30;
-controlling expenditure on patient transport.
III.-1° An authorisation to put into service a vehicle exclusively assigned to interventions carried out within the framework of emergency medical assistance under article R. 6312-36-1 may not be transferred;
2° The person holding an authorisation to put into service a vehicle exclusively assigned to interventions carried out as part of emergency medical assistance under article R. 6312-36-1 must inform the regional health agency of any change in the location of the vehicle.
