Article R641-31 of the French Commercial code

I.-Articles R. 624-13 to R. 624-15 shall apply to judicial liquidation proceedings subject to the following provisions:

The application made on the basis of articles L. 624-9, L. 624-10, L. 624-18 or L. 624-19 shall be sent to the liquidator. The applicant shall send a copy to the court-appointed administrator, if one has been appointed.

Even in the absence of a prior request for restitution, the juge-commissaire may be seized by the liquidator.

II.-In the event of a claim on the price of the assets pursuant to Article L. 624-18, the corresponding sums paid by the sub-purchaser subsequent to the opening of the proceedings shall be remitted to the claiming creditor by the liquidator.

Article R641-31

I.-Les articles R. 624-13 à R. 624-15 sont applicables à la procédure de liquidation judiciaire sous réserve des dispositions suivantes :

La demande formée sur le fondement des articles L. 624-9, L. 624-10, L. 624-18 ou L. 624-19 est adressée au liquidateur. Le demandeur en adresse une copie à l’administrateur judiciaire, s’il en a été désigné.

Même en l’absence de demande préalable de restitution, le juge-commissaire peut être saisi par le liquidateur.

II.-En cas de revendication du prix des biens en application de l’article L. 624-18, les sommes correspondantes payées par le sous-acquéreur postérieurement à l’ouverture de la procédure sont remises au créancier revendiquant par le liquidateur.
