Article R642-20 of the French Commercial code

In the case provided for in the third paragraph of article L. 642-12, the assignee must inform the liquidator in advance of any planned disposal of an asset. He must also inform the court if the disposal was not envisaged when his offer was filed under the conditions set out in 7° of II of article L. 642-2.

The liquidator, informed by the assignee under the conditions of the first paragraph or ex officio, notifies the juge-commissaire and the creditors benefiting from a droit de suite, if any, without delay.

Dans le cas prévu au troisième alinéa de l’article L. 642-12, le cessionnaire informe préalablement le liquidateur de tout projet d’aliénation d’un bien cédé. Il est également tenu d’en informer le tribunal si l’aliénation n’était pas envisagée lors du dépôt de son offre dans les conditions du 7° du II de l’article L. 642-2.

Le liquidateur, informé par le cessionnaire dans les conditions du premier alinéa ou d’office, avertit sans délai le juge-commissaire et les créanciers bénéficiant d’un droit de suite s’il y en a.
