Disputes shall be lodged within thirty days of the date of insertion in the Bulletin officiel des annonces civiles et commerciales advising of the filing of the statement of collocation. They are made by petition delivered or addressed to the registry of the enforcement judge of the judicial court before which the judicial liquidation proceedings were conducted or in whose jurisdiction the proceedings were conducted.
The challenge is, on pain of inadmissibility, notified, within ten days of its filing at the registry, to the creditors in question and to the liquidator by a bailiff’s deed. This act shall indicate that the creditors and the liquidator must constitute a lawyer within fifteen days of the notification.
Challenges shall be decided in accordance with the procedure applicable before the enforcement judge. The articles R. 311-4, R. 311-6 first paragraph and R. 311-7 of the Code of Civil Enforcement Procedures are applicable.
