Article R643-4 of the French Commercial code

As soon as the sale is published, the liquidator shall request from the land registry service a statement of the subsisting registrations in accordance with Article 2449 of the Civil Code, with a view to settling the order between the creditors and proceeding with the distribution of the price.

In the event of a sale by mutual agreement, the liquidator, either ex officio or at the request of the purchaser or any interested party, shall proceed to open the order, after the purchaser has completed the purging formalities prescribed by articles 2464 et seq. of the Civil Code and paid the price to the Caisse des dépôts et consignations.

Dès la publication de la vente, le liquidateur requiert du service de la publicité foncière l’état des inscriptions subsistantes conformément à l’article 2449 du code civil, en vue de régler l’ordre entre les créanciers et procéder à la distribution du prix.

En cas de vente de gré à gré, le liquidateur soit d’office, soit requis par l’acquéreur ou par tout intéressé procède à l’ouverture de l’ordre, après accomplissement, par l’acquéreur, des formalités de purge prescrites par les articles 2464 et suivants du code civil et versement du prix à la Caisse des dépôts et consignations.
