Article R644-1 of the French Commercial code

Where the decision on the application to the proceedings of the rules of simplified judicial liquidation, provided for in Chapter IV of Title IV of Book VI, falls within the jurisdiction of the president of the court, the latter shall decide ex officio in the light of the liquidator’s report.

This decision is a judicial administrative measure not subject to appeal. It is communicated to the debtor and the liquidator and is mentioned in the registers provided for in the first four paragraphs of Article R. 621-8.

Article R644-1

Lorsque la décision sur l’application à la procédure des règles de la liquidation judiciaire simplifiée, prévue au chapitre IV du titre IV du livre VI, relève de la compétence du président du tribunal, celui-ci statue d’office au vu du rapport du liquidateur.

Cette décision est une mesure d’administration judiciaire non susceptible de recours. Elle est communiquée au débiteur et au liquidateur et est mentionnée aux registres prévus aux quatre premiers alinéas de l’article R. 621-8.
