Article R645-14 of the French Commercial code

After obtaining the opinion of the public prosecutor, the assigned judge files his report with the court registry no later than three days before the hearing. However, where an application is made to open judicial liquidation proceedings pursuant to the provisions of Article L. 645-9, the report may be filed and brought to the debtor’s attention on the day of the hearing.

Après avoir recueilli l’avis du ministère public, le juge commis dépose son rapport au greffe du tribunal au plus tard trois jours avant l’audience. Toutefois, lorsqu’est demandée l’ouverture de la procédure de liquidation judiciaire en application des dispositions de l’article L. 645-9, le rapport peut être déposé et porté à la connaissance du débiteur le jour de l’audience.
