Article R645-23 of the French Commercial code

If the judgment opening the professional recovery proceedings or closing them is overturned or set aside, the court of appeal may, of its own motion, rule on the application to open the judicial liquidation proceedings.

En cas d’infirmation ou d’annulation du jugement ouvrant la procédure de rétablissement professionnel ou la clôturant, la cour d’appel peut, d’office, statuer sur la demande d’ouverture de la procédure de liquidation judiciaire.
