Article R663-15-1 of the French Commercial code

The plan execution commissioner shall be allocated, in respect of the due diligence he has carried out in the context of new cash contributions provided for in the third paragraph of Article L. 626-26, a fee, the amount of which is set by order made pursuant to Article L. 444-3, taking into account the cumulative amount of these contributions mentioned in the judgment modifying the plan.

This remuneration is earned only upon proof of payment of the funds.

Article R663-15-1

Il est alloué au commissaire à l’exécution du plan, au titre des diligences qu’il a effectuées dans le cadre de nouveaux apports de trésorerie prévus au troisième alinéa de l’article L. 626-26, un émolument dont le montant est fixé par arrêté pris en application de l’article L. 444-3, tenant compte du montant cumulé de ces apports mentionnés dans le jugement modifiant le plan.

Cette rémunération n’est acquise que sur la justification du versement des fonds.
