Article R681-3 of the French Commercial code

The court shall assess in a single judgment whether the conditions for opening mentioned in 1° and 2° of article L. 681-1 are met, alternatively or cumulatively.

When a case is referred to the territorially competent over-indebtedness commission under IV of article L. 681-2, the court registry sends a copy of the judgment and all the documents in the case file to the secretariat of this commission without delay.

Where article L. 681-3 is applied, the court registry will immediately forward a copy of the judgment and all the documents in the case file to the secretariat of the territorially competent over-indebtedness commission.

Article R681-3

Le tribunal apprécie dans un même jugement si les conditions d’ouverture mentionnées aux 1° et 2° de l’article L. 681-1 sont, alternativement ou cumulativement, réunies.

Lorsque la commission de surendettement territorialement compétente est saisie en application du IV de l’article L. 681-2, le greffe du tribunal transmet sans délai au secrétariat de cette commission une copie du jugement et de l’ensemble des pièces du dossier.

Lorsqu’il est fait application de l’article L. 681-3, le greffe du tribunal transmet sans délai au secrétariat de la commission de surendettement territorialement compétente une copie du jugement ainsi que l’ensemble des pièces du dossier.
