Article R681-6 of the French Commercial code

A creditor who is not a party to a judgment mentioned in article R. 681-5 may contest the separation of the assets of the sole trader by declaration to the court registry within a period of ten days from the notification made to him, or from the publication of the judgment in the Bulletin officiel des annonces civiles et commerciales.

In the event of a dispute, the sole trader, known creditors, the judicial representative, the public prosecutor and the judicial administrator, where one has been appointed, are summoned by any means and without delay by the court registry.

Le créancier qui n’est pas partie à un jugement mentionné à l’article R. 681-5 peut contester la séparation des patrimoines de l’entrepreneur individuel par déclaration au greffe du tribunal dans un délai de dix jours à compter de la notification qui lui a été faite, ou à compter de la publication du jugement au Bulletin officiel des annonces civiles et commerciales.


En cas de contestation, l’entrepreneur individuel, les créanciers connus, le mandataire judiciaire, le ministère public et l’administrateur judiciaire, lorsqu’il en a été désigné un, sont convoqués par tout moyen et sans délai par le greffe. Le tribunal recueille leurs observations et statue sur l’ensemble des contestations soulevées.
