Article R711-1 of the French Intellectual Property Code

The trade mark shall be represented in the national trade mark register in an appropriate form by means of commonly available technology, provided that it can be represented in that register in a clear, precise, distinct, easily accessible, intelligible, durable and objective manner.

This representation may be accompanied by a description provided that it corresponds to the representation of the trade mark and does not extend the scope of protection.

Where the trade mark falls within one of the types of trade marks defined by decision of the Director General of the Institut national de la propriété industrielle, it shall be accompanied by an indication which corresponds to the representation of the trade mark.

The representation of the trade mark cannot be validly ensured by the filing of a sample or specimen.

The arrangements for the representation of the trade mark shall be specified by decision of the Director General of the Institute.

La marque est représentée dans le registre national des marques sous une forme appropriée au moyen de la technologie communément disponible, sous réserve de pouvoir être représentée dans ce registre de façon claire, précise, distincte, facilement accessible, intelligible, durable et objective.

Cette représentation peut être accompagnée d’une description sous réserve que celle-ci corresponde à la représentation de la marque et n’étende pas la portée de la protection.

Lorsque la marque relève de l’un des types de marques définis par décision du directeur général de l’Institut national de la propriété industrielle, elle est accompagnée d’une indication qui correspond à la représentation de la marque.

La représentation de la marque ne peut pas être valablement assurée par le dépôt d’un échantillon ou d’un spécimen.

Les modalités de représentation de la marque sont précisées par décision du directeur général de l’Institut.
