Article R712-10 of the French Intellectual Property Code

Any filing shall give rise to verification by the Institute:

1° That the application for registration and the documents annexed thereto comply with the requirements of the laws and regulations in force;

2° That the mark may not be validly registered pursuant to 1° to 10° of Article L. 711-2;

3° That, where applicable, the trade mark may not be refused registration pursuant to Articles L. 715-4 and L. 715-9.

Tout dépôt donne lieu à vérification par l’institut :

1° Que la demande d’enregistrement et les pièces qui y sont annexées sont conformes aux prescriptions de la législation et de la réglementation en vigueur ;

2° Que la marque ne peut être valablement enregistrée en application des 1° à 10° de l’article L. 711-2 ;

3° Que, le cas échéant, la marque ne peut être refusée à l’enregistrement en application des articles L. 715-4 et L. 715-9.
