The owner of the trademark shall be informed by the National Institute of Industrial Property of the expiry of the registration, no later than six months before such expiry. Failure to provide such information shall have no effect on the expiry of the registration.
The registration may be renewed for a further period of ten years by declaration of the proprietor of the trade mark or any authorised person, drawn up in accordance with the conditions laid down in the decision referred to in Article R. 712-26. It may be specified that the renewal is valid only for certain goods or services designated in the act of registration.
The renewal takes effect on the day following the date of expiry of the registration.
The declaration must, on pain of inadmissibility:
1° Be submitted within a period of one year immediately preceding the date of expiry of the registration and be accompanied by proof of payment of the prescribed fee.
However, the declaration may still be submitted and the fee paid within a further period of six months from the day following the day on which the registration expires, subject to payment of an additional fee within the same period.
2° Contain the designation of the trade mark to be renewed and emanate from the proprietor entered, on the day of the declaration, in the National Trade Mark Register or from the authorised person.
If the declaration does not satisfy these conditions, the procedure provided for in 1° of Article R. 712-11 shall be applied.
Inadmissibility may not be declared without the applicant having been given the opportunity to submit observations.
