The granting by a network institution of the guarantees mentioned in 3° of article R. 712-7 is subject to the following rules:
1° The granting of guarantees means the granting of loan guarantees or sureties granted to natural or legal persons under private or public law;
2° Transmission of the resolution adopting a proposal to grant a guarantee to a third party is accompanied by documents and information specifying the purpose of the guarantee, the status of the third party beneficiary, its corporate purpose and, where applicable, any other guarantees it may have received from the network institution over the last five years;
3° Where the granting of the guarantee falls within the scope of the control of public aid by Community legislation, the project is notified to the European Commission at the initiative of the supervisory authority. In this case, the deadline for approval set out in article R. 712-8 is suspended until receipt of the decision from the Community authorities. In the event of a negative decision, the refusal of approval notified to the president of the institution is accompanied by the decision of the European Commission.
