Article R712-7 of the French Intellectual Property Code

Any filing that does not include the information provided for in Article R. 712-3 (1° a, b and c) and which is not accompanied by proof of payment of the filing fee.

However, this inadmissibility can only be invoked by the Institut national de la propriété industrielle after the applicant has been invited to complete the missing information. The request for regularisation shall state that if no regularisation is made within the time limit set, the application will be declared inadmissible.

If the regularisation is made within the time limit, the filing date to be taken into account is the date on which the missing particulars were filed.

Est déclaré irrecevable tout dépôt qui ne comporte pas les mentions prévues à l’article R. 712-3 (1° a, b et c) et qui n’est pas accompagné de la justification du paiement de la redevance de dépôt.

Toutefois, cette irrecevabilité ne peut être opposée par l’Institut national de la propriété industrielle qu’après que le déposant a été invité à compléter les mentions manquantes. La demande de régularisation mentionne qu’à défaut de régularisation dans le délai fixé le dépôt sera déclaré irrecevable.

Si la régularisation est effectuée dans le délai, la date de dépôt à prendre en compte est celle à laquelle les mentions manquantes ont été produites.
