Article R712-8 of the French Intellectual Property Code

Any filing recognised as admissible shall be published in the Official Bulletin of Industrial Property, unless it appears either that its presentation does not meet the technical requirements necessary to allow its reproduction, or that its publication would be of such a nature as to infringe public policy or morality.

Publication in the Official Bulletin takes place within six weeks of receipt of the filing at the National Institute of Industrial Property. Mention is made therein of the option open to any person to make observations within a period of two months and to the persons mentioned in Article L. 712-4-1 to file an opposition to registration within the same time limit.

Tout dépôt reconnu recevable est publié au Bulletin officiel de la propriété industrielle, sauf s’il apparaît soit que sa présentation ne satisfait pas aux prescriptions techniques nécessaires pour permettre sa reproduction, soit que sa publication serait de nature à porter atteinte à l’ordre public ou aux bonnes mœurs.

La publication au Bulletin officiel intervient dans les six semaines qui suivent la réception du dépôt à l’Institut national de la propriété industrielle. Mention y est faite de la faculté ouverte à toute personne de formuler des observations dans un délai de deux mois et aux personnes mentionnées à l’article L. 712-4-1 de former dans ce même délai opposition à enregistrement.
