Article R7122-20 of the French Labour Code

No later than at the time of recruitment, the employer shall send to the authorised body the first part of the declaration enabling the obligation provided for in article L. 1221-10 to be met. The employer is exempted from sending the documents provided for in article R. 1221-3.

When the employer does not have the declaration before the actual start of work, he shall comply with the provisions of articles R. 1221-1 to R. 1221-12, relating to the declaration prior to recruitment.

In all cases, there is no derogation from the methods of proof provided for in article R. 1221-5.

Au plus tard lors de l’embauche, l’employeur adresse à l’organisme habilité le premier volet de la déclaration permettant de satisfaire à l’obligation prévue à l’article L. 1221-10. L’employeur est dispensé des envois prévus à l’article R. 1221-3.


Lorsque l’employeur ne dispose pas de la déclaration avant le début effectif du travail, il satisfait aux dispositions des articles R. 1221-1 à R. 1221-12, relatives à la déclaration préalable à l’embauche.


Dans tous les cas, il n’est pas dérogé aux modes de preuve prévus à l’article R. 1221-5.
