Article R7124-19-5 of the French Labour Code

The duration of the suspension of approval may not exceed one month. Within this period, the commission, after receiving a referral from the administrative authority defined in article R. 7124-1, proposes to the latter, after the employer concerned has been given the opportunity to present its observations:

1° Either the withdrawal of the authorisation;

2° Or the lifting of the suspension if the measures taken by the employer are such as to eliminate the risks incurred by the child and to avoid their recurrence.

The suspension ends on expiry of the one-month period if the administrative authority defined in article R. 7124-1 has not made its final decision known within this period.

La durée de la suspension de l’agrément ne peut excéder un mois. Dans ce délai, la commission, saisie par l’autorité administrative définie à l’article R. 7124-1, propose à cette dernière, après que l’employeur concerné a été mis en mesure de présenter ses observations :


1° Soit le retrait de l’agrément ;


2° Soit la levée de la suspension si les mesures prises par l’employeur sont de nature à supprimer les risques encourus par l’enfant et à éviter leur renouvellement.


La suspension prend fin à l’expiration du délai d’un mois si l’autorité administrative définie à l’article R. 7124-1 n’a pas fait connaître sa décision définitive dans ce délai.
