Article R7124-5 of the French General Code of Local Authorities

An order of the State representative records the appointment of the members of the Economic, Social, Environmental, Cultural and Education Council, with the exception of the members mentioned in 9° and 10° of Article R. 7124-1.

If one or more seats cannot be filled in accordance with the procedures laid down for the appointment of their incumbent, they remain vacant. However, where the appointment must be made by agreement between two or more associations or bodies and it has not been possible to reach such an agreement, the State representative shall convene a meeting of the parties concerned for the purpose of conciliation. At the end of this meeting, if no agreement has been reached, the State representative shall record the appointment as a member representing these associations or bodies of the person or persons whose name has been proposed by a majority of them or, in the event of a tie, by drawing lots.

The personalities mentioned in 9° and 10° of article R. 7124-1 are appointed by order of the State representative.

Un arrêté du représentant de l’Etat constate la désignation des membres du conseil économique, social, environnemental, de la culture et de l’éducation, à l’exception des membres mentionnés aux 9° et 10° de l’article R. 7124-1.

Si un ou plusieurs sièges ne peuvent être pourvus selon les modalités prévues pour la désignation de leur titulaire, ils restent vacants. Toutefois, lorsque la désignation doit être faite par accord entre deux ou plusieurs associations ou organismes et que cet accord n’a pu intervenir, le représentant de l’Etat réunit les parties en cause aux fins de conciliation. A l’issue de cette réunion, si aucun accord n’a pu être trouvé, le représentant de l’Etat constate la désignation comme membre représentant ces associations ou organismes de celui ou ceux dont le nom a été proposé par la majorité d’entre eux ou, en cas d’égalité, par tirage au sort.

Les personnalités mentionnées aux 9° et 10° de l’article R. 7124-1 sont nommées par arrêté du représentant de l’Etat.
