Article R714-8 of the French Intellectual Property Code

Any entry made in the National Register of Trademarks shall be mentioned in the Official Bulletin of Industrial Property.

Any interested person may obtain from the Institute:

1° A certificate of identity including the design of the mark, the indications relating to the filing and registration, and, where applicable, the limitations to the list of goods or services resulting from a withdrawal, renunciation, division or decision;

2° A reproduction of the entries made in the National Register of Marks;

3° A certificate stating that no entry exists.

From the day of the publication provided for in the first paragraph, any interested person may request to inspect a trademark application file and obtain a reproduction of the documents at his own expense. The Institute may make use of this option subject to proof of a sufficient interest.

However, documents not communicated to the applicant and those containing personal data or relating to business secrets shall be excluded from communication to the public.

Toute inscription portée au Registre national des marques fait l’objet d’une mention au Bulletin officiel de la propriété industrielle.

Toute personne intéressée peut obtenir de l’institut :

1° Un certificat d’identité comprenant le modèle de la marque, les indications relatives au dépôt et à l’enregistrement, et, s’il y a lieu, les limitations à la liste des produits ou services résultant d’un retrait, d’une renonciation, d’une division ou d’une décision ;

2° Une reproduction des inscriptions portées au Registre national des marques ;

3° Un certificat constatant qu’il n’existe pas d’inscription.

A compter du jour de la publication prévue au premier alinéa, toute personne intéressée peut demander à prendre connaissance d’un dossier de demande d’enregistrement de marque et obtenir à ses frais reproduction des pièces. L’institut peut subordonner l’usage de cette faculté à la justification d’un intérêt suffisant.

Toutefois, sont exclues de la communication au public les pièces non communiquées au déposant ainsi que celles qui comportent des données à caractère personnel ou qui sont relatives au secret des affaires.
